Our Ref: Brief Report

Brief Report

The purpose of this letter is to keep you informed of recent developments.

1. New Membership:

We are proud to announce that we have 4 members from the Northern Cape and would therefore mean that we are able to represent 8 Provinces. We welcome all new members. We have been invited to Upington to continue with the drive for membership and to spread what SANAPS is all about.

2. The Rules Board:

The Rules Board will be sitting on the 19 November 2011 and it is highly probable that some of the issues relating to Rule 46 and our fees may be settled. We will keep members informed.

3. The Consultative Forum:

The Forum will be sitting provisionally on the 27 October 2011. We are deeply concerned with the retraction of premium subsidies by the Board. It is hoped that this issue will be urgently clarified before the annual premium becomes due.

4. The Computer Empowerment Project:

So far the only Province that has come forward with its membership’s needs is the Eastern Cape. KZN, Gauteng, Western Cape and Limpopo have indicated that there are no needy Sheriffs in their Province. We await a response of the Northern Cape,Mpumalanga, and the North West Province. This project was supposed to have closed on the 26 September 2011. Please respond to this urgently.

5. Nominations to the PAC’s:

Thus far, I have received 1 nomination from Gauteng that is Paul Sedile and a further nomination from the Eastern Cape that is Robert Lawrence de Lange. Please note that this nominations closes on the 17 October 2011 and that a brief profile needs to be forwarded to SANAPS which will in turn be forwarded to the Board. We once more reiterate that no Sheriff applying for a post should avail himself. The remainder of the Provinces are urgently reminded to forward their nominations.

6. SABFS Nominations:

As members are aware, the nominations have opened. We kindly request that every applicant considers the following before availing themselves. The applicant must have a sound and in depth knowledge of the profession. The applicant must have a good understanding of the Sheriffs Act High and Low Court Acts as well as other Acts applicable to the profession that regulates the services and execution of processes. The applicant must have a strong personality and must be able to deeply debate issues against those who may have other views without fear or favour. The applicant must also be able to strike a balance in furnishing feed back to the profession without compromising restricted issues generated from the Board. No Chairperson of SANAPS should avail himself / herself for the nomination. We will broadly take into consideration Governments, gender and demographic guidelines. No Acting Sheriff may be nominated. Only Sheriffs nominated by the profession should qualify within this category as envisioned by the Sheriffs Act. 2 nominations are required by the Province, this nomination closes by the 4 November 2011. Please attend to this urgently.

Yours faithfully,

Mr. A. M. Makwetu.
